Where liability cannot be excluded, Bitcap's aggregate liability is limited to the greater of CAD $100 or amounts paid by you directly to Bitcap for website-related services in the three (3) months preceding the claim.

You agree to defend, indemnify, and hold harmless Bitcap and its related parties from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the website, your breach of these Terms, or your violation of law or third-party rights.
